Shipped Semen Breeding Agreement
This agreement is entered into the day of , ,2008 by and between , hereinafter referred to as "OWNER", and M.Cheri McCann, hereinafter referred to as "OPERATOR".
Whereas, Owner owns/leases the below described mare and desires Operator to breed said mare for the terms set forth herein; and,
Whereas, the parties desire to agree on the terms and conditions of such breeding.
Now, therefore, it is hereby agreed as follows:
1. Description of horse:
Owner agrees to breed on or about , the following described mare with a negative culture, biopsy, or other written veterinary statement of breedability (except in the case of known maiden mares):

For best results mare should be stalled at night in a lighted stall for two months prior to breeding. This will help ensure regular cycling for breeding when delivered.
2. Payment for breeding:
Owner agrees to pay Operator the sum of $500.00 stud fee - payable prior to breeding of mare & $150 per shipment of chilled semen after 2 free shipments.
3. Duties of Operator:
Ship semen from Arabian stallion - / or / Quarterhorse stallion – C.E. Lil Bit of Wood registration number 4341258 in a manner consistent to ensure viability. Ship semen in a timely manner with the assistance of a veterinarian (Dr. Tim Stewart, Hank Lee or Dr. Weekley) working with the Owner's veterinarian so as to best ensure insemenation for optimum conception. Breeding will be done 1 Feb '08 till 1 July '08 as indicated till mare is vet checked (2 week ultrasound - Faxed printout) as pregnant. Operator will be notified after each vet check so problems and alternate solutions may be discussed.
Breeding is guaranteed until a live foal (stands and nurses-lives 24 hours) is produced by said breeding. Loss should be documented by letter from alicensed veterinarian within one week.
4. Expenses:
Owner shall bear all costs of transportation incidental to the purposes of this agreement, including, but not limited to, veterinary and medical costs, special equipment ; however, such expenses shall not exceed $ without Owner's prior approval. A refundable deposit of $75.00 may be required for the shipping container (in those instances where a disposable container can not be obtained) in the case of shipped semen due before shipping. Payment terms shall be in accordance with paragraph 2 above.
5. Accounting and Billing by Operator:
Operator shall pay all expenses referred to in Paragraph 4, keep an accurate account thereof, and bill Owner for the same at the end of each month. If Owner fails to reimburse Operator for such expenses when payable, Operator is authorized to deduct an amount equal to such expenses from Owner's account, if any, held by Operator.
6. Term and Termination of Agreement:
The term of this agreement shall be for the breeding year of 2008 except as noted elsewhere. In the event the mare is unbreedable due to health reasons or death of the mare or the stallion the Owner may substitute another mare or have the stud fee returned. Such problems to be documented by letter from a licensed veterinarian within one week. Breeding fee may be carried forward one year in problem cases.
7. Binding Effect on Successors/Attorney Fees: Law
This agreement shall be binding upon the assigns, heirs, executors and administrators of the respective parties.
Should either party breach this agreement, the breaching party agrees to pay the other's reasonable attorney fees and court costs related to such breach.
This agreement shall be interpreted and construed in accordance with the laws of the State of Florida.
